Peter (Season 1) and Sylar have the same ability, they have empathic mimicry, but Peter is somewhat more empathic with anyone, Sylar in another way is a loner so he doesn't empathize with anyone but Elle (Season 3), either way, to get a better understanding of the ability, Sylar needs to see how the brain manipulates it, that's why he opens the head. Peter doesn't know what to do with what he has. So Sylar wins.
